Gov. Bush Seeks Evidence in Schiavo Case

CLEARWATER, Fla. (AP) - Gov. Jeb Bush has asked an appeals court for permission to collect evidence in a severely brain-damaged woman's right-to-die case.

Terri Schiavo, 40, has been the subject of a long legal battle between her husband, who has sought to disconnect her feeding tube, and her parents, who believe she can be rehabilitated and want to take care of her.

Michael Schiavo, Terri Schiavo's husband, is challenging the constitutionality of a law that allowed Bush to order her feeding tube reinserted six days after it had been removed in October.

The governor is appealing a decision by a judge presiding over the case that Bush could not question witnesses or collect evidence.

In a filing on Tuesday, Bush questioned whether Terri Schiavo would want her husband in charge of her "end-of-life decisions" if she knew he was living with another woman and had two children with her.

George Felos, attorney for Michael Schiavo, called the issues raised by the governor irrelevant or already decided upon.
