A Texas couple is fighting to regain custody of their 12-year-old cancer-stricken daughter after the state seized the girl, claiming her parents have not done enough to treat her.

A judge has postponed until tomorrow a ruling on whether or not doctors can treat Katie Wernecke against her parents' wishes, KPRC-TV in Houston reported.

Katie's parents, Michele and Edward Wernecke of Agua Dulce, Texas, say their daughter's Hodgkin's disease is in remission and she doesn't need radiation treatment after undergoing a round of chemotherapy. Mr. Wernecke is worried that more treatment will have harmful long-term effects on his daughter and wants an opinion from doctors outside Driscoll Children's Hospital in Corpus Christi.

But the Texas Child Protective Services believe the recommendations of doctors at the hospital should overrule the parents. Robert Rosetti, program director over investigations at the CPS Nueces County office, claims the parents are being "medically neglectful."

Speaking this morning on NBC's "Today" show, Michele Wernecke said her daughter's illness is unique and should be treated as such.

"I think they should treat her for what her body calls for and not standard protocol. Nobody will look at that," she said. "Not every cancer is the same. Nobody understands that. Her body is not standard, and her cancer is not standard."


The Werneckes, members of the Church of God, have said they oppose blood transfusions unless they are from Katie's mother, but she is not a match, according to doctors.

Their attorney, Daniel Horne, however, said religion isn't at issue. He says his clients don't believe doctors haven't been upfront about Katie's care and have not answered all their questions about radiation's side effects.

"This issue is about parental rights, not about religious rights," Horne said. "They just want to be informed of her treatment. They want to be involved in this."

Last week, the state issued an Amber Alert that led to the seizure of Katie, who is undergoing tests at the University of Texas M.D. Anderson Cancer Center in Houston. The couple's three sons were also taken and are in a foster home.

Michele Wernecke was arrested on charges of interfering with child custody and was released Monday after posting $50,000 bond.

According to KPRC-TV, juvenile court Judge Carl Lewis said in a hearing yesterday he would wait until Friday to make a decision on the radiation treatment after receiving more information from doctors.

Katie, who was diagnosed with cancer in January, does not want the treatment.

"I don't need radiation treatment. And nobody asked me what I wanted. It's my body," she said in a videotaped message to her parents.

The family maintains a blog entitled Pray for Katie on which her parents claim she is being used in a research project.

States the blog: "Why are the doctors doing this? Katie appears to be part of a study where they allocate kids randomly to one treatment, say standard chemo plus radiation, and chemo only in the other treatment. Parents are not informed of this. They are doing research on our kids. Collecting research money from the drug companies, I guess."

A custody court hearing is set for June 15.

CPS CAME TO GET KATIE
Child Protective Services (CPS) showed up a my door late this afternoon with an ORDER FOR PROTECTION OF A CHILD IN AN EMERGENCY AND NOTICE OF HEARING. They had orders to remove Katie and I told them she was not here. I told them I needed to have it explained to me by my attorney which I could not reach by phone even though I had his cell phone number for an emergency. I told them they needed a search warrant and they said the court order was enough. They wouldn't wait any longer and forced their way into my house and completely searched it and meanwhile CPS took pictures of everything. Katie wasn't here as I told them.

What this means is the CPS department is named temporary sole managing conservator of Katie and once they get her they will do the radiation treatments on her without her consent and without her parents consent and all this without a court hearing to determine if any of the allegations are true, which they are not, and if any of the statements by the doctors are true.

This is not medical neglect and she is not at risk of dying or injury without this treatment. I had arranged for a third opinion today with a Dr. Voorhees and her Dr. Alter knew this and ignored and did not arrange the referal as the nurse Laura Wendland said they would. I have actively sought the best treatment for Katie. We believe the radiation may not be necessary at this time. She is at risk for injury from the radiation treatments that far exceed their benefit. Reseach has shown the five year survival rate for Chemo alone to be superior to Chemo + Radiation. Believe, me I have spent much time reseaching this before reaching this conclusion.

Why are the doctors doing this, Katie appears to be part of a study where they allocate kids randomly to one treatment, say standard Chemo + Radiation, and Chemo only in the other treatment. Parents are not informed of this. They are doing research on our kids. Collecting research money from the drug companies I guess. Dr. Alter said before " I don't need your permission to do it." This is wrong. Parents (should) have a right to choose the best medical treatment for their child. Apparently not in Texas. The State (CPS) is trying to do it for my child. This is not a case of medical neglect where I have not sought treatment or refused to allow my child to be treated. She went through 4 chemo treatments and we had to watch her suffer through that ordeal and were by her side all the way, the doctor and nurses weren't there for her. Call the Hospital, demand a full investigation, go public, get tv and radio stations to pick up the story and interview the parents. We may be in jail by then, so hurry.

There is a full adversary hearing on June 15, 2005 at 10:00 AM in the County Court at Law #5 of Nueces County, in Corpus Christi, Texas. Please attend and support Katie, we need to pack the court room, I need character witnesses so I don't lose all my kids permanantly from these trumped up charges.

Yes, they took all my kids. Jonathan and Joshua and James. That again wasn't indicated by the facts, but a ploy by CPS to force us to give them Katie I suppose. Katie wasn't here, thank God, and I don't know where she is, cause if they get ahold of her they will force these treatments on her and she doesn't even want them.

We must stop this brutality and the overstepping of CPS powers and forcing kids to get treatments without their parents approval. Dr. Alter is largely at fault here because of the trumped up charges saying that she would die without this treatment. That is not true and he can't prove it. Dr. Alter can be reached at Driscoll Childrens Hospital at 361-694-5311. Call him and tell him you don't like what he did and God will punish him for it. He doesn't believe in the power of God and prayer. We urgently need a doctor that will take Katie's side.

While you are calling Drisoll Childrens Hospital call the President Rick Merrill at 361-694-5021 and voice your disapproval of Dr. Alter's treatment of Katie and involving CPS with this fine christian family. There motto is "Hope and Healing for 50 years" Katie's hope and healing is in jeopardy. She is healing just fine on her own with God's help.

I need legal help. I have an attorney he didn't protect me from this. I don't want to lose the battle in court, this is more than about just Katie, its about all our kids, mine, and yours. And about our rights to choose the medical care for our children.

It strikes me as ironic that most of these people are in Corpus Christi... that means the Body of Christ. The Body that was abused horrifically for our healing. The Body that holds the Anointing for healing, salvation and deliverance.

Father I pled the Blood of Jesus over Katie. I speak the Revelation of Truth in this court case. I speak healing over this Family. Have Mercy on the people in this fight. Bring Your Truth to light in the court room. Bring the children home to their parents and show the world Your healing power as they watch Katie's miracle healing. In the Name of Jesus I break infirmity off of Katie, I break the powers of the CPS and State in this matter and I send them to the foot of Jesus. Thank you Lord. AMEN!

First, they refuse treatement to Terri Schiavo? Now, they try to force treatment on this girl? WACKY!

Dear Lord, I pray that You will intervene and heal Katie. I pray she is alive and well and it is proved she doesn't need the radiation treatment. Show Dr. Alter that she is fine. Reverse this situation in favor of the parents and in favor of what it best for Katie's helath. In Jesus Name, amen.

Lord- We pray that your will be done in this situation. you know best what is going on here and pray you will stop any illegal and unnecessary actions being taken and put this daughter under your watch and protection, that she is not harmed or her body not damaged unnecessarily by this situation. We ask for resolve for this and a return of authority over this daughter by her parents. Lord, just straiten this mess out so it is best for this daughter and her predicament. in Jesus Name- Amen!!
